Welcome to Spokable! These Terms of Service ("Terms") govern your use of the Spokable voice-controlled interactive storytelling platform and related services (collectively, the "Service") operated by Spokable ("we," "us," or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.

1. Eligibility

You must be at least 13 years old to use the Service. If you are between 13 and 18 years old, you must have your parent or legal guardian's permission to use the Service.

By using the Service, you represent and warrant that:

  • You have the legal capacity to enter into these Terms
  • You are not barred from using the Service under any applicable laws
  • You will comply with these Terms and all applicable laws and regulations

2. Account Registration

Account Creation

To access certain features of the Service, you must create an account. You may register using your email address and password or through third-party authentication services such as Google OAuth.

Account Responsibilities

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use of your account
  • Ensuring that your account information is accurate and up-to-date

You may not:

  • Use another person's account without permission
  • Create multiple accounts for fraudulent purposes
  • Share your account credentials with others

3. Use of the Service

License to Use

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use.

Acceptable Use

You agree not to:

  • Use the Service for any illegal or unauthorized purpose
  • Violate any laws in your jurisdiction
  • Harass, abuse, or harm other users
  • Impersonate any person or entity
  • Interfere with or disrupt the Service or servers
  • Attempt to gain unauthorized access to any portion of the Service
  • Use any automated system to access the Service without our permission
  • Reverse engineer or attempt to extract the source code of the Service
  • Upload viruses or any other type of malicious code
  • Use the Service to send spam or unsolicited messages

4. Content

Your Content

When you use the Service, you may provide input through voice commands, text, or other means ("User Content"). You retain ownership of your User Content, but you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display your User Content solely for the purpose of providing and improving the Service.

Our Content

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of Spokable and its licensors. The Service is protected by copyright, trademark, and other intellectual property laws.

Content Standards

You agree that your User Content will not:

  • Contain any material that is defamatory, obscene, offensive, or inappropriate
  • Promote violence or discrimination
  • Infringe any patent, trademark, copyright, or other intellectual property rights
  • Violate the privacy rights of others
  • Contain any material that could give rise to criminal or civil liability

5. Voice Data and Privacy

The Service processes voice commands to enable gameplay. By using voice features, you consent to the temporary processing of your voice data. We do not permanently store raw voice recordings. For more information, please see our Privacy Policy.

6. Purchases and Subscriptions

Fees

Some parts of the Service may be offered for a fee. You agree to pay all fees associated with your use of the Service. All fees are non-refundable unless otherwise stated.

Billing

We use third-party payment processors to process payments. By providing payment information, you represent and warrant that you have the legal right to use any payment method you provide.

Subscriptions

If you purchase a subscription:

  • Your subscription will automatically renew unless canceled
  • You may cancel your subscription at any time through your account settings
  • Cancellation will take effect at the end of the current billing period
  • We may change subscription fees upon reasonable notice

7. Intellectual Property

The Service and its original content, features, and functionality are owned by Spokable and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

8. Third-Party Services

The Service may contain links to third-party websites or services that are not owned or controlled by us. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

Your use of third-party services, including Google OAuth for authentication, is governed by their respective terms and policies.

9. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, expressed or implied, regarding the Service, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

We do not warrant that:

  • The Service will be uninterrupted, secure, or error-free
  • The results obtained from the Service will be accurate or reliable
  • Any errors in the Service will be corrected

10. Limitation of Liability

To the maximum extent permitted by law, Spokable shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

  • Your use or inability to use the Service
  • Any unauthorized access to or use of our servers and/or any personal information stored therein
  • Any interruption or cessation of transmission to or from the Service
  • Any bugs, viruses, or other harmful code transmitted through the Service
  • Any errors or omissions in any content

11. Indemnification

You agree to defend, indemnify, and hold harmless Spokable and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees arising out of or relating to your violation of these Terms or your use of the Service.

12. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the Service will cease immediately. All provisions of these Terms which should reasonably survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

13. Modifications to the Service

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

14. Changes to These Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or by posting a notice on the Service prior to the effective date of the changes.

Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of the changes.

15. Governing Law and Dispute Resolution

Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States and the State of California, without regard to its conflict of law provisions.

Dispute Resolution

Any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in California, and judgment on the award may be entered in any court having jurisdiction.

Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

16. General Provisions

Entire Agreement

These Terms constitute the entire agreement between you and Spokable regarding the use of the Service.

Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

Assignment

You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign our rights under these Terms without restriction.
